The petitioner is accused in connection with N.D.P.S. Case No. 75 of 2012 arising out of Palanwa P.S. Case No. 78 of 2012 registered under sections 20(B), 22, 23 and 24 of the N.D.P.S. Act pending in the Court of 3rd Additional Sessions Judge-cum-Special Judge, Motihari (East Champaran). Learned counsel appearing on behalf of the petitioner submits that earlier prayer of the petitioner for bail was rejected vide Cr. Misc. No. 33354 of 2013 on 24.03.2014 by this Court on merit. It is also submitted that petitioner, having no criminal antecedent, is in custody since 01.07.2012. Admittedly, prayer of the petitioner for bail was earlier rejected taking into consideration the 84 kilograms of

Patna High Court Cr.Misc. No.32988 of 2015 (2) dt.29-07-2015 2/2 recovered Ganja from the house of the petitioner. As such, I am not inclined to re-consider the prayer of the petitioner for bail. Accordingly, this application is rejected.
