Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Bhore P.S. Case No. 270 of 2020 registered for offence punishable under sections 341, 323, 307, 302, 447, 325, 504 and 506/34 of the Indian Penal Code.
As per FIR, there is specific allegation against the petitioner that he brutally assaulted the father-in-law of the informant by inflicting repeated blows by handle of hand-pump on his head. The father-in-law of the informant was initially
Patna High Court CR. MISC. No.45097 of 2021(4) dt.08-08-2022 2/2 treated in Gopalganj hospital, but thereafter, his condition became serious and he was referred to Gorakhpur where he died.
The learned counsel for the petitioner has submitted that both the parties are agnates and the reason of occurrence has not been mentioned.
There is specific allegation against the petitioner that he inflicted repeated blows on the father-in-law of the informant and he died during the course of treatment. The witnesses, in paragraph 5, 16, 17, 19, 30, 31 and 32 of the case diary, have supported the occurrence, as such, the petitioner does not deserve the privileges for anticipatory bail. Accordingly, his prayer for anticipatory bail is hereby rejected. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
