The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 326 of the Indian Penal Code.

The petitioner is not named in the First Information Report. The informant simply stated that his father was stabbed in his neck who fled away to the door of Shiv Kumar Yadav and died immediately thereafter. The mother of the informant also stated but she did not disclose the name of any of the accused. After three months of the occurrence, the mother of the informant and widow of the deceased alleged names of three persons in her petition filed before the Chief Judicial Magistrate and disclosed that two persons caught her husband and petitioner stabbed in his

Patna High Court Cr.Misc. No.34640 of 2015 (2) dt.20-08-2015 P2/2 neck. But, she did not disclose the source of her information. Although, she did not name any person in her earlier statement before Police recorded in Paragraph No. 7 of the case diary. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S.
