2. In this present case, the petitioner seeks bail in connection with Karpurigram P.S. Case No. 22 of 2025 registered for the offences under Sections 309(4) and 317(2) of the B.N.S.
3. As per prosecution case, four persons at point of knife, forcibly snatched the E-rikshaw of the informant. One of which was apprehended when police gave chase and intercepted the E-rikshaw and other three persons. Petitioner is stated to be one of the escaped miscreants.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Name of the petitioner transpired in the confessional statement of co-accused Dipen Kumar @
Patna High Court CR. MISC. No.37813 of 2025(2) dt.18-06-2025 2/3 Vipin Kumar who is co-villager of the petitioner and there is serious dispute between them. In order to take revenge, the coaccused named this petitioner in this case. Till date no Test Identification Parade has been carried out to establish the identity of the petitioner. Nothing incriminating has been recovered from the person or posession of this petitioner. The co-accused, who named the petitioner in this case, has been granted bail vide order dated 19.05.2025 passed in Cr. Misc. No. 31968 of 2025 by a Co-ordinate Bench of this Court. Other similarly placed co-accused persons have also been granted bail vide order dated 19.05.2025 passed in Cr. Misc. No. 31746 of 2025 and Cr. Misc. No. 32158 of 2025 by the same Co-ordinate Bench. Petitioner is in custody since 21.02.2025 and chargesheet has been submitted. Petitioner is having antecedent of one case.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that no recovery has been shown from the petitioner and further considering the grant of bail to co-accused who named this petitioner and also considering the period of custody and

No.37813 of 2025(2) dt.18-06-2025 3/3 submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Samastipur/concerned court in connection with Karpurigram P.S. Case No. 22 of 2025, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
