JUSTICE RAJIV ROY ORAL ORDER 08-02-2023 Heard learned counsel for the petitioner and the learned APP for the State The petitioner apprehends his arrest in connection with Dhansoi P.S. Case No.97 of 2017 instituted under Sections 323,341,498A,34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act.
As per the FIR, lodged in 2017 the allegation is that the petitioner who was married to the lady in 2003 tortured her for dowry and further, when she was working in Mumbai, the allegation is that the petitioner developed illicit relationship with his 'Bhabhi' as also the local prostitutes and further allegation is that the place where she worked, the accused persons took away the money from the employer and she had to beg for the

From the record, it seems that the petitioner had earlier unsuccessfully tried for anticipatory bail in 2017 and after rejection of the same, he remained an absconder and again in 2022 he took fresh steps for filing anticipatory bail. Considering the conduct/attitude of the petitioner, certainly this is not a fit case for extending anticipatory bail, which is accordingly rejected.
