2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 420, 467, 468 of the Indian Penal Code and section 30(a), 36, 41(i) of the Bihar Prohibition & Excise Act.
3. There is recovery of 4298.4 litres of IMFL from a truck. The petitioner is alleged to have fled away from the place of seizure.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He was neither arrested on spot nor anything was recovered from his conscious possession. Similarly situated other accused person
Patna High Court CR. MISC. No.39024 of 2024(2) dt.17-05-2024 2/2 has already been enlarged on bail by this Court vide order dated 2.9.2022 passed in Cr. Misc. No. 26718 of 2022.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Exclusive Spelcial Excise Court no. 1-cum-Additional District and Sessions Judge, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 14 of 2021.
