JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-10-2016 Learned counsel for the petitioner prayed for restoration of M.J.C. No. 1843 of 2014 which was dismissed on 10.02.2015 for non-compliance of the peremptory order dated 03.02.2015. In view of order dated 03.02.2015, one week time was granted to the petitioner to remove the defects as pointed out by the office, but only defect no. 1 regarding correction of provision of law was removed, but the defect regarding non-filing of limitation petition was required to be removed by filing limitation petition.
Patna High Court MJC No.2506 of 2016 (4) dt.26-10-2016 In view of submission as detailed in M.J.C. No. 2506 of 2016, M.J.C. No. 1843 of 2014 is restored to its original file, subject to filing of limitation petition within a period of three weeks.
