The petitioner is apprehending his arrest in a case complaint case in which cognizance has been taken for the offences punishable under Section 498(A) of the Indian Penal Code.
The accusation against the petitioner is of torture for non-fulfillment of dowry demand.
The petitioner is husband of the complainant. It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.45090 of 2021(7) dt.22-02-2022 2/3 that petitioner and the complainant have decided to part ways. Both sides agreed that a sum of Rs. 7,00,000/- will be paid by the petitioner to the complainant as one time settlement and in this respect, a demand draft of Rs. 7,00,000/- bearing D.D No. 504029 dated 11.02.2022 has already been handed over to the complainant. Both sides agreed to withdraw the cases filed against each other. Both the parties have also filed a petition under Section 13(B) of the Hindu Marriage Act for dissolution of marriage. A joint supplementary affidavit to that effect has been filed before this Court bringing on record the above facts. The learned counsel appearing on behalf of the complainant does not controvert the aforesaid submissions of the learned counsel for the petitioner.
Considering the fact that both sides have amicably decided to settle the dispute and steps have been taken to finally resolve the dispute between the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Raxaul, East Champaran, Motihari in connection with Complaint Case No.
