2. The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 378 of 2024, instituted for the offence under Sections 191(2), 190, 127(2), 121(1), 132, 119(1), 352 of the B.N.S. and Sections 30(a) and 45 of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 12 litres country made liquor has been recovered from the house of co-accused persons. It is alleged that co-accused Rambabu Mahto was apprehended on the spot but forcefully he was gotten free from the police custody by the named accused persons including the petitioner and 50 to 60 persons of the locality.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. He was not present on the spot. The allegation against the petitioner is being the member of the mob. Petitioner is a young boy, aged about 20 years having no criminal antecedent. He undertakes to co-operate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the Petitioner, above-named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Court No. 1, East Champaran at Motihari in connection with Muffasil P.S. Case No. 378 of 2024, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023. (Sunil Dutta Mishra, J.) rakhi/- U T
