The petitioner seeks bail in Mokama P.S. Case No.165 of 2001 instituted for the offences under Sections 147, 148, 149, 307, 353, 332 and 333 of the Indian Penal Code and Section 27 of the arms Act.
Earlier this Court vide order dated 19.12.2013 passed in Cr. Misc. No.49875 of 2013 rejected the prayer for bail of the petitioner with a liberty to expedite the trial. This Court while rejecting the bail directed the trial court to expedite the trial but nothing material has substantiated.
Looking to the nature of allegation, this Court is not
Patna High Court Cr.Misc. No.38834 of 2015 (2) dt.26-08-2015 inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, this Court directs the Sr. Superintendent of Police, Patna to ensure the production of witnesses without unnecessary delay and the trial court is directed to conclude the trial within a period of nine months from the date of receipt/production of this order.
