2. The petitioner apprehends his arrest in connection with Complaint Case No. C-1286 of 2024 registered for the offence under Section 498(A) of the Indian Penal Code.

3. As per the prosecution case, the petitioner and others are said to have assaulted the victim for demand of dowry.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the petitioner and the opposite party no. 02 have entered into a compromise

Patna High Court CR. MISC. No.35786 of 2025(3) dt.17-02-2026 2/3 and in support of the same, a supplementary affidavit has also been filed. He next submits that as per the terms of settlement the petitioner has to pay Rs. 5,60,000/- to the opposite party no. 02.

5. Learned counsel for the opposite party no. 02 has also supported that the dispute between the parties have been settled.

6. In view of the settlement between the parties, this application is allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on provisional anticipatory bail for a period of six months from today on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, East Champaran at Motihari/concerned Court below in connection with Complaint Case No. 1286 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.

8. It is made clear that the provisional bail granted to the petitioner will be subject to the fact that he will pay Rs.

No.35786 of 2025(3) dt.17-02-2026 3/3 5,60,000/- to the informant in six monthly installments which comes to around Rs. 94,000/- per installment and the bail bonds of the petitioner shall only be accepted if he produces a demand draft of Rs. 94,000/- i.e. the first installment in the name of the informant. Once, the whole agreed amount of Rs. 5,60,000/- is paid to the informant then the provisional anticipatory bail granted to the petitioner shall be confirmed. (Sandeep Kumar, J) Vikas/- U
