Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner seeks bail in Dinara P.S. case No.153 of 2017 bearing S.Tr. No.303 of 2019 registered under Sections 341, 323, 307, 34 of the Indian Penal Code and 27 of the Arms Act, pending in the court of Additional District and Sessions Judge I, Sasaram, Rohtas. Later on, Sections 302, 120(B) of I.P.C. has been added.

The earlier bail application of the petitioner was rejected vide Annexure 1 series to the present application taking into account that the petitioner is one of the assailants and the

Patna High Court CR. MISC. No.2411 of 2021(3) dt.24-03-2021 2/2 F.I.R. is dying declaration.

A report was called for from the court below regarding the stage of trial. It has been reported that the trial is expected to be concluded within a period of four months. Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of four months from the date of receipt/production of a copy of this order. The District Magistrate, Rohtas at Sasaram and the Superintendent of Police, Rohtas at Sasaram are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, Rohtas at Sasaram and the Superintendent of Police, Rohtas at Sasaram.
