The petitioner seeks bail in a case under Section 379 of the Indian Penal Code and under section 136 of Electricity Act. The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. Co-accused confessed their guilt in another case and also admitted that they along with petitioner committed theft of electric wire. Save and except confession of co-accused there is no material to show involvement of the petitioner.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri P. Krishna, learned Judicial Magistrate, 1st class, Bagaha, West Champaran in Semra P.S. Case No. 51/2014.
