JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and Shri Anil Kumar Singh, the learned A.P.P. for the State. The petitioner seeks regular bail in connection with Sasaram Nagar P.S. Case No. 167 of 2020 for the offence registered under Sections 290/34 of the Indian Penal Code, Sections 3(I), 3(2), 4, 5, 6 and 7 of the Immoral Traffic (Prevention) Act and Sections 4/6 of the POCSO Act. The prosecution case in brief is that on 02.03.2020 the informant got secret information that illegal sex trafficking is being done by the Manager of the Dhaba Kaimur and for the

No.34912 of 2020(2) dt.21-12-2020 2/3 verification of the same, the informant along with some police personnel reached there and in front of two witnesses the hotel was raided and there they found six boys and six girls in compromising position and it further transpired that the Manager of the aforesaid hotel engages in illegal sex trafficking in lieu of money. Those six boys along with the Manager of the hotel were then arrested and their mobile phones were seized. The learned counsel for the petitioner has submitted that the girls recovered from the hotel have not said anything adverse about the petitioner herein. It is further submitted that similarly situated co-accused persons have already been granted bail by a coordinate Bench of this Court vide order daed 09.11.2020 passed in Criminal Misc. No. 24493 of 2020. Per contra, the learned counsel for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the parity of the case of the petitioner with that of the co-accused persons who have already been granted bail by a coordinate Bench of this Court, apart from the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge, Sasaram, Rohtas in connection with Sasaram Nagar P.S. Case No. 167 of 2020, POCSO Case No. 28 of 2020.
