16-11-2021 Heard learned counsel for the parties.

The petitioners seek bail in Gopalganj Town P.S. Case No. 414 of 2021, registered for the offence under Sections 30(a), 41(1), 32(3) of Bihar Prohibition and Excise Act and Section 414, 34 of the Indian Penal Code.

72 liters & 160 ml. of illicit foreign liquor has been recovered from a car, of which, petitioner no. 1 was driver and petitioner no. 2 was co-passenger.

It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of the petitioners. Petitioners have got clean antecedent and they are in custody since 16.06.2021. Investigation is complete.

Patna High Court CR. MISC. No.45771 of 2021(2) dt.16-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the quantity of seized liquor, period of custody and clean antecedent of petitioners, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge cum Special Judge, Gopalganj in connection with Gopalganj Town P.S. Case No. 414 of 2021.
