The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
The prosecution case in nutshell is that the petitioner has parked his motorcycle in front of his house and next day in the morning he found the door of his house locked form outside and his motorcycle was missing. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and he has falsely been implicated in the present case. It is also submitted that on the basis of confessional statement of co-accused
Patna High Court CR. MISC. No.36099 of 2022(2) dt.29-11-2022 2/2 Dharmendra Ram whose statement was recorded in Karpi P.S. Case No. 139 of 2015, the name of the petitioner sprang up in this case. It is also submitted that neither the petitioner is apprehended from spot nor anything incriminating has been recovered from his conscious possession.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VIII, Patna in connection with Parsa Bazar P.S. Case No. 107 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
