1. Heard learned counsel for the petitioner and learned APP for the State.

2. A prayer for bail has been made on behalf of the petitioner in connection with Gogri P.S. Case no.48 of 2025 registered under section 37 of the Bihar Prohibition and Excise Act.

3. The allegation in the F.I.R is that the petitioner was arrested on the ground of being drunk and on examination by the breath analyzer machine, 900.0 mg/100ml alcohol was found.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case since he had some dispute with the police personnel. He further submits that no independent witness is there on the seizure list further

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. Taking into consideration the above mentioned facts of the case, the petitioner is directed to be enlarged on bail in connection with Gogri P.S. Case no.48 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge of Excise-I, Khagaria. (Soni Shrivastava, J) Harsh/- U T
