Petitioner is an accused in a case registered for the offence under sections 399 and 402 of the Indian Penal Code and under the Arms Act.

Police raided a place and arrested the petitioner and his two associates while planning to commit an offence. One loaded country made pistol has also been recovered from his possession.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to ulterior motive. He also disputes the seizure list as the same does not bear the signature of the petitioner over it. Learned counsel appearing for the petitioner further submits that

Patna High Court CR. MISC. No.36560 of 2019(3) dt.04-09-2019 2/2 charge sheet has already been submitted in the instant case. Petitioner is in custody since 25.8.2018 and similarly situated co-accused, Mintu Kumar @ Gachiya Paswan @ Mintu Kuwar, aged about 32 years, son of Banarasi Paswan, resident of village Gachhi Tola, Police Station Town Begusarai, has already been allowed regular bail by a bench of this Court vide order dated 29.4.2019, passed in Cr.Mis.No. 25670 of 2019. Considering the facts of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Barauni (Refinery) Police Station Case No. 413 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
