JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 07.09.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State and also heard learned counsel for the informant.

Petitioner, being bank manager of the concerned bank, sanctioned loan to co-accused Basant Choudhary on the basis of documents furnished by him but later on, it was detected that numbers of land given by Basant Choudhary in the documents belonged to the informant and when the aforesaid fact came to notice of the petitioner, he immediately wrote letter to the concerned official of Registry for cancellation of the deed and subsequently, a fresh deed was executed rectifying the error occurred in earlier deed. Moreover, co-accused Basant Choudhary has already been granted privilege of bail by a coordinate bench of this court.

Learned counsel appearing for the informant submits that up till now, bank has not issued no objection certificate in favour of the

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri V.K. Chaubey, Judicial Magistrate, Ist Class, Muzaffarpur/ concerned court in Kathaiya P.S. Case no. 59/2014.

However, it is made clear that the concerned bank must issue no objection certificate in favour of the informant within two weeks from today, if the same has not been issued to the informant as yet.
