JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act.

One country made loaded pistol and two live cartridges are said to have been recovered from conscious possession of the petitioner but submission on behalf of the petitioner is that having, similar allegation, co-accused Vijay Kumar Singh @ Dabloo Singh has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 13.11.2018 passed in Cr. Misc. No. 3835 of 2019. It is further submitted that no doubt Para-3 of the

No.33379 of 2019(2) dt.21-05-2019 2/2 petition goes to show that earlier petitioner was made accused in nine cases but as a matter of fact, when the petitioner was arrested in the present case, he was made accused in five cases which had been lodged against unknown persons. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 18.11.2018 and also with an object to maintain parity of justice, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- XIV, Saran at Chapra in connection with Garkha P.S. Case No. 495 of 2018.
