2. The petitioner seeks bail in connection with Teghrha P.S. Case No. 53 of 2024 registered for the offences under Sections 363 & 365 of the IPC.

3. The petitioner is named in the F.I.R. and is in custody since 04.03.2024.

4. The allegation against the petitioner is to kidnap the minor brother of the informant aged about 16 years.

5. Learned counsel appearing on behalf of the petitioner submitted that petitioner settled in village of her inlaws and due to local disputes and differences, he was

It is submitted that petitioner was acquainted with victim and out of said acquaintance he gave lift to the brother of informant on his bicycle for a short local destination on the request of his brother of the informant till Pakthaul Chowk which is apparent from CCTV footage. It is submitted that save and except suspicion nothing incriminating appears against this petitioner, who remains in custody for about one and half years being a man of clean antecedent. It is submitted that even charge could not be framed in this matter against petitioner despite of his aforesaid custody.

6. Learned APP duly assisted by learned counsel for the informant while opposing the prayer for bail submitted that specific allegation is available against this petitioner, but he could not dispute aforesaid factual submission as advanced by learned counsel for the petitioner.

7. In view of aforesaid factual submission and by taking note of fact as prima-facie petitioner implicated with the present case due to suspicion arising out of CCTV footage, coupled with the fact as petitioner remains in custody since
