The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 307, 504 of the Indian Penal Code and section 27 of the Arms Act. As per allegation in the FIR, while the informant was returning after attending an invitation, an accused person came there covering his face started indiscriminate firing upon him as a result of which he received gun shot injuries in his neck, abdomen and thigh.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not named in the FIR. No injury report is brought on record. There is no eye witness of the prosecution case. Petitioenr is

Patna High Court CR. MISC. No.39362 of 2022(3) dt.04-01-2023 2/2 languishing in judicial custody since 2/5/2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gopalganj in connection with Sidhwalia P.S. Case No. 117 of 2021.
