The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The informant named five persons including the petitioner and alleged that all the five persons assaulted his brother Sunil Kumar Singh. The informant and others also got injuries. The informant took his brother to hospital for treatment and brought him to his house after treatment, but all of a sudden on 22.05.2015 brother of the informant died.
It is submitted that there is omnibus and general allegation. The occurrence took place on 19.05.2015, but the FIR was lodged on 22.05.2015. The post-mortem report does not
Patna High Court Cr.Misc. No.35880 of 2015 (2) dt.26-08-2015 2/2 support the prosecution version. Similarly situated co-accused Ameerchand Singh has already been enlarged on anticipatory bail by a Bench of this Court vide order passed in Cr. Misc. No. 32914 of 2015.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur (Bhabua) in Mohania P.S.
