Petitioner seeks bail in a case registered for the offences punishable under Section 354(B) of the Indian Penal Code, Sections 4, 8 and 12 of the Protection of Children from Sexual Offenses Act, 2012.

Petitioner is in custody since 21.05.2020. The victim in her statement under Section 164 Cr.P.C. stated that in the night of 20.05.2020, the petitioner, who is neighbour, came on the roof of her house, dragged her cloth and caught her hand. However, the victim made alarm and the petitioner fled away. Petitioner has got no criminal antecedent. Investigation of the case against the petitioner is already complete. Considering the nature of allegation and period already undergone by the petitioner, let the petitioner, above

No.33840 of 2020(5) dt.09-03-2021 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No. 90 of 2020 arising out of Masaurhi Police Station Case No. 313 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
