Petitioner seeks bail in Nayagaon P.S. Case No.47 of 2018 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is not named in the First Information Report.

It is alleged in the written report that Chaukidar got information that near village Dumri Chituwakar Ghaat two dead bodies are lying. People had gathered on the spot and identified one person as Sawah Mahto. Another dead body could not be identified. From perusal of dead bodies, it appears that they might have been killed by gun shot. First Information Report has been drawn against unknown.

No.37503 of 2019(3) dt.25-07-2019 2/2 During investigation, name of the petitioner has been disclosed by co-accused, Jawala Pd. and Manu Rai in their confessional statements recorded before police in Garkha P.S. Case No. 495 of 2018. Thereafter, police remanded the petitioner in the instant case.

Counsel for the petitioner further submits that coaccused, Jawala Prasad and Manu Rai, have already been granted regular bail vide Annexure-2 and 3.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, XIII, Saran at Chapra, in connection with Nayagaon P.S. Case No.47 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
