Petitioner apprehends arrest in a case registered for the offence punishable under Sections 399, 402 and 414 of Indian Penal Code and Sections 25(1-B)a, 26 and 35 of Arms Act.

As per prosecution case, 3 persons were apprehended with arms and ammunition and some cash, who disclosed the name of this petitioner.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case and his name has only been transpired during the course of investigation. Nothing has been recovered from conscious possession of the petitioner. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances, let

Patna High Court CR. MISC. No.36258 of 2022(2) dt.07-11-2022 2/2 the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari (East Champaran) in Sugauli P. S. Case No. 135 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) navya/- U T
