JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being elder brother in law of the deceased is languishing in jail custody since 02.05.2015 in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.

It would appear from perusal of the first information report that the informant got information about the death of the deceased on 02.07.2014 and on the same day she visited the house of the petitioner but she gave written report to concerned police station on 04.07.2014. Moreover, investigation of the present case has already been completed and the stand of the petitioner is that

Patna High Court Cr.Misc. No.34303 of 2015 (2) dt.21-08-2015 2/2 he is separate from his brother.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Samastipur in connection with Sessions Trial No. 418 of 2015 arising out of Samastipur Mufassil P.S. Case No. 262 of 2014.
