JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2020 Heard Mr. Abhay Shankar Singh, learned counsel for the petitioners and learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Vidyapatinagar P.S. Case No. 34/2019 instituted for the offence under Sections 304(B) / 34 of the Indian Penal Code.

The petitioners are stated to be the younger brother of the husband of the deceased.

No.28211 of 2020(2) dt.04-12-2020 2/3 It has been submitted on behalf of the petitioners that the deceased actually committed suicide and considering the circumstances of the case which reflected the death of the deceased by suicide, the husband of the deceased was granted bail by a Bench of this Court vide order dated 17.02.2020 passed in Cr. Misc. No. 66817 of 2019. It has also been submitted that the petitioners were not even present in their village at the time of the death of the deceased. The deceased was being treated for her mental disorder for a very long time and she always displayed abnormal behaviour.

Considering all these facts in totality, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Dalsingsarai, Samastipur, in connection with Vidyapatinagar
