For the Petitioner/s : Mr. Surendra Prasad Singh For the Opposite Party/s : Mr. Ambika Bhagat(Spl .A P.P.) ====================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE ORAL ORDER 28-08-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accused-petitioner, namely, Gauri Shanker Rai, in connection with Nautan Police Station Case No. 263 of 2014, under Sections 328/365/376(D) of the Indian Penal Code, Section 6 of the Protection of Children for Sexual Offence Act, 2012 and Sections 3(1)(xii)/2(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Perused the above application and materials on record.

Heard Mr. Surendra Prasad Saingh, learned Counsel for the petitioner, and Mr. Ambika Bhagat, learned Additional Public Prosecutor, appearing on behalf of the

Patna High Court Cr.Misc. No.35770 of 2015 (2) dt.28-08-2015 2/2 State.

Considering the nature of incriminating materials available against the accused above-named, this Court is of the view that at this stage, the accused above-named shall not be allowed to go on bail.

In view of the above and in the interest of justice, the prayer for bail is hereby rejected at this stage. This bail application shall stand disposed of accordingly.
