JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present case was lodged against unknown person and the name of petitioner came in this case in course of investigation in confessional statement of co-accused, Surendra Singh, who has already been granted privilege of bail by a coordinate Bench of this Court. Moreover, petitioner happens to be co-villager of informant and had he participated in the alleged crime, he would have certainly been named in the first information report.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.34398 of 2015 (2) dt.28-08-2015 2/2 two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Naugachia, Bhagalpur in connection with Bihpur P.S. Case No. 41 of 2013.
