JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of victim has been recorded u/S 164 of the Cr. P.C. in which, she stated that she was taken away by the co-accused, Chandra Rai, Kapildeo Rai and one another and after that, she was confined in the house of Chandra Rai. Furthermore, she stated that she was brought to village-Bariyarpur, where she was confined in the house of co-accused, Bilas Rai, who happens to be elder brother of the petitioner. Furthermore, the victim stated that co-accused, Bilas Rai asked the victim to solemnize her marriage with the petitioner.
Learned counsel for the petitioner submits that petitioner was neither involved in taking away the victim nor in
Patna High Court Cr.Misc. No.36979 of 2015 (3) dt.03-11-2015 2/2 making proposal of marriage.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Majorganj P.S. Case No. 18 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi. (Hemant Kumar Srivastava, J) A.K.V./- U T
