The petitioner has renewed his prayer for anticipatory bail in connection with K. Hat P.S. Case No. 355 of 2009 registered for the offences punishable under Sections 420, 406, 467 and 468 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Purnea. The petitioner was earlier granted anticipatory bail vide order dated 30.10.2013 passed in Cr. Misc. No. 49087 of 2012 on the undertaking to return Rs.3,05,300/- within a period of six weeks and remaining amount of Rs.3,00,000/- in two equal installments within a period of six

The petitioner could not comply the order and thereafter filed Cr. Misc. No. 45349 of 2014 for modification of order dated 30.10.2013 passed in Cr. Misc. No. 355 of 2009. The modification application was disposed of vide order dated 18.12.2014 with liberty to the petitioner to seek regular bail. Hence, in view of the order dated 18.12.2014 passed in Cr. Misc. No. 45349 of 2014 the present anticipatory bail application is not maintainable.

Accordingly, this application is dismissed.
