JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 22-05-2025 At the outset, learned counsel appearing for the petitioners seeks permission to withdraw the application for grant of anticipatory bail to petitioner no.4, namely, Rakesh Kumar @ Lalu.

2. Request allowed.

3. Considering the aforesaid, the application for grant of anticipatory bail to the petitioner no.4 stands dismissed as withdrawn.

4. Now, the petition survives only for petitioner nos. 1, 2 and 3, namely, Manju Devi, Bindu Devi and Dhauli Devi.

5. The accused/petitioners are named in the FIR and apprehending their arrest in connection with Baligaon P.S. Case No.166 of 2024 registered under Sections 190, 191(2), 191(3) and 103 of the Bhartiya Nyaya Sanhita, 2023 (in short 'B.N.S.').

6. Allegation against the petitioners is to involve in murder of father of the informant along with 23 named and 8-10 unknown accused persons.

It is submitted by learned counsel appearing for the petitioners that petitioner nos. 1, 2 and 3 being female family members of male co-accused persons were implicated with present case alleged with general and omnibus allegation. It is submitted that there is no any overt act available against these petitioners. It is submitted that the occurrence took place in the background of land dispute and petitioners are said to be ladies of clean antecedent.

8. Learned APP opposes the prayer of bail.

9. In view of aforesaid facts and circumstances and by taking note of the fact as prima facie petitioners, who are ladies of clean antecedent implicated with present case being

No.34237 of 2025(2) dt.22-05-2025 3/3 the female family members of the male co-accused persons, accordingly, the petitioners no. 1, 2 and 3 namely, Manju Devi, Bindu Devi and Dhauli Devi are directed to be released on bail, in the event of their arrest or surrender in the court below within a period of four weeks, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Baligaon P.S. Case No.166 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/under Section 482(2) of the BNSS.
