The petitioner seeks bail in a case registered for the offence punishable under Sections 427 and 387 of the Indian Penal Code and u/s 3⁄4 of Explosive Substance Act. Informant has alleged that in the night in his shop unknown persons hurled a bomb as a consequence of which the shutter of the shop was damaged and shop was filled with smoke. He has further alleged that one and half years before he had received a phone call for payment of ransom. FIR is against unknown.

It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case on suspicion. The petitioner is not named in the FIR and he

Patna High Court CR. MISC. No. 35187 of 2019(3) dt.30-08-2019 2/2 is in custody since 28.08.2018. Charge sheet has been submitted in this case. Similar situated co-accused has been granted by the Co-ordinate Bench of this Hon'ble Court in Cr. Misc. No. 65422 of 2018 dated 10.01.2019.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after framing of the charge on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S.
