For the Opposite Party/s :
Mr. Narsingh Tanti, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 20-10-2022 Let the defect(s), if any, be removed within two weeks from today.
Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Ara Muffasil P.S. Case No. 40 of 2022 lodged under Sections 302/201 of the I.P.C.
As per the prosecution case, the dead body of the informant's brother was found and upon getting information, the informant lodged the F.I.R. and filed the criminal case against unknown criminals.
Learned counsel for the petitioner submits that petitioner is the wife of deceased. He submits that her name has been figured in this case by the virtue of confessional statement of one Ranjeet Kumar. There is no direct evidence against the petitioner and she is in custody since 10.02.2022 having clean antecedent.
Patna High Court CR. MISC. No.35933 of 2022(3) dt.20-10-2022 2/2 Learned counsel for the State opposes the prayer for bail and submits that the confessional statement indicates that in the said crime, the active involvement of petitioner was there, as she killed her husband in connivance with the said co-accused Ranjeet Kumar, with whom she was in love. But upon specific query, whether charge has been framed or not, learned counsel for the petitioner submits that charge has not framed in this case. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present.
However, liberty is hereby granted to the petitioner that she may renew her prayer for bail 9 months after framing of charge and Trial Court, thereafter, shall release the petitioner on bail imposing conditions, so that, she may not evade her appearance during trial.
With this observation, the bail application stands rejected.
