The petitioner seeks bail in case for the offences punishable under Sections 414, 467 and 468 of the Indian Penal Code.

Allegedly, the petitioner was caught by the informant and another police personnel when he was trying to hide himself and on interrogation he told that he is the owner of the vehicle no. BR06P- 6468 and produced the paper, which on enquiry was found forged and fabricated.

Submission is of false implication and that nothing has been recovered from the conscious possession of the petitioner. The petitioner has been made accused in other cases due to high handness of the police. The petitioner is not the owner of the said vehicle and after thought he has been implicated in this case resulting he is suffering in custody from 11.4.2015. In other cases, the petitioner is on bail.

Patna High Court Cr.Misc. No.34573 of 2015 (4) dt.23-11-2015 2/2 Learned A.P.P. opposes the prayer of bail by submitting that the petitioner produced forged paper regarding that vehicle. In the facts and circumstances of the case, as stated above, considering that the charge sheet has already been submitted and there is no chance of tampering with the prosecution evidence and as such considering his custody, the petitioner, Ajeet Kumar @ Ajit Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with G.R.P.,Patna (Rajendra Nagar P.P.) P.S.Case No.

132 of 2015, subject to the conditions that one of the bailors must be a near relative having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
