The petitioner seeks bail in Rajauli P.S. Case No. 336 of 2019, registered for the offence punishable under Section 395 of the Indian Penal Code.

As per the prosecution case, while the informant (driver) along with Khalasi was returning after unloading the stones from truck, on the way, four miscreants got down from a white colour Scorpio vehicle snatched their mobiles and took away the truck.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Binay Kumar @ Bigan Kumar. No incriminating article has been recovered

Patna High Court CR. MISC. No.45516 of 2021(2) dt.15-11-2021 2/2 from possession of this petitioner. Co-accused Binay Kumar has been granted bail by this Hon'ble Court vide order dated 02.03.2020 passed in Cr. Misc. No. 10181 of 2020 vide Annexure-2. Petitioner is in custody since 05.02.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 336 of 2019.
