JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-09-2015 Heard both sides The petitioner seeks bail in a case under Sections 498(A), 302, 34 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected vide order dated 24.12.2014 passed in Cr. Misc. no. 29741/2014. The petitioner is the husband of the deceased. The wife of the petitioner was burnt to death.
Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on bail in Asarganj P.S. Case No. 44 of 2013, corresponding to G.R. No. 1788/2013, S.T. No. 38/2014. Accordingly, the same is rejected.
After perusal of the report of the trial court, it appears that the trial court has conducted the trial very leisurely. The trial court is directed to hold the trial on day-to-day basis and conclude
Patna High Court Cr.Misc. No.36270 of 2015 (3) dt.23-09-2015 2/2 the same within nine months from the date of receipt / production of this order.
