Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Hisua P.S. Case No. 168 of 2020, registered for the offences punishable under Sections 379 of the Indian Penal Code and 135 Indian Electricity Act 2003.
As per allegation, the petitioner by pilfering electric line, was running his flour mill. He was a connection holder but it was disconnected by the Electricity Department. Due to act of the petitioner the Department has suffered a loss of Rs. 147207/-. Learned counsel for the petitioner has submitted that petitioner is ready to deposit 25 % of the loss sustained by the
Patna High Court CR. MISC. No.45542 of 2021(3) dt.30-08-2022 2/2 Electricity Department.
Learned counsel for the informant has submitted that the petitioner was granted benefit of Section 41(1) of the Cr.P.C. and there is no apprehension of his arrest.
Considering the fact that the petitioner has been granted benefit of Section 41 (1) Cr.P.C. He is directed to surrender before the court below and make a prayer for regular bail. The Petitioner is directed to deposit 25 percent of the amount mentioned in the FIR. With these observations, the criminal miscellaneous petition is disposed of.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
