JUSTICE SATYAVRAT VERMA ORAL ORDER 04-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Desari P. S. Case No.287 of 2020, instituted for the offences under Section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 08.01.2021 and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that on 09.10.2020 at about 9.00 A.M. when he was returning by bike and reached on NH-322, two criminals intercepted him and stopped his bike and took his bag from the dickey on the point of weapon in which Rs.29,788/- was kept along with tap, mobile etc.

No.44870 of 2021(2) dt.04-01-2022 2/2 The learned counsel for the petitioner submits that the F.I.R. is against unknown and this petitioner came to be implicated in the present case based on his own confessional statement made when he was arrested in Baligaon P. S. Case No.146 of 2020.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 08.01.2021, charge-sheet has been submitted in the case and he came to be implicated based on his confessional statement, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XV, Vaishali at Hajipur in connection with Desari P. S. Case No.287 of 2020, subject to condition that one of the bailers shall be the father of the petitioner. The application stands allowed.
