JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 354A of the IPC and sections 7/8 of the POCSO Act.

Prosecution case is that the petitioner molested informant's daughter by pressing her breast.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, petitioner is a school teacher and when he expelled the victim using unfair means in the examination, with ulterior motive instant case has been filed against him. Moreover, the victim in her statement recorded under section 164 Cr. P. C. has denied the prosecution allegation. Petitioner has got no criminal antecedent.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Exclusive Special Court, POCSO Act, Rohtas at Sasaram in Nokha (Rohtas) Police Station Case No. 107 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
