JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner, learned Additional Public Prosecutor and perused the case diary. The petitioner is in custody in connection with Imamganj P.S.Case No.158 of 2018 registered for an offence under sections 304 and 34 of the Indian Penal Code. The prosecution case is that petitioner rashly and negligently driving the vehicle and dashed the informant's daughter on the road, due to which the daughter of the informant died at the spot.
It is submitted on behalf of the petitioner that the petitioner is simply driving the vehicle and it is a case of Section 304A of the IPC which is bailable in nature. He further submits that petitioner has got no criminal antecedent and he is in
Patna High Court CR. MISC. No.34123 of 2019(5) dt.28-08-2019 2/2 custody since 04.04.2019.
In the view of the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Sherghati, Gaya in connection with Imamganj P.S.Case No.158 of 2018 with condition that the petitioner shall fully cooperate in the trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
