Heard learned counsels for the petitioner, informant and the State.
The petitioner being husband of the informant is languishing in custody since 20.12.2014 in a case registered for the offences punishable under Sections 498A,323 and 494 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.
The basic accusation is of torture for non fulfillment of dowry demands and performance of second marriage. It is submitted by the learned counsel for the petitioner that earlier the petitioner was granted provisional anticipatory bail
Patna High Court Cr.Misc. No.5449 of 2015 (4) dt.22-07-2015 2/2 on his readiness to make payment of Rs.1500/- per month to the informant from November, 2012 but since he made default in making payment, his bail bonds were cancelled. Considering the nature of accusation and period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Khagaria in connection with Choutham P.S.
