2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Bandhua Kurawa P.S. Case No. 111 of 2024, lodged on 31.12.2024, under Sections 103(1), 238, 3(5) of the B.N.S., 2023.
3. As per the prosecution, F.I.R. has been lodged against two named accused persons including the present petitioner. The informant has disclosed that the marriage of her daughter was solemnized with co-accused but due to certain dispute her daughter was residing at Mayka. It has been specifically alleged that the son-in-law alongwith his friend (petitioner) has visited the house of the informant and requested
Patna High Court CR. MISC. No.34375 of 2025(2) dt.03-06-2025 2/2 to visit Chandan Dam, thereafter she was not returned and her dead body was recovered.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that petitioner has clean antecedent and he is in custody since 04.01.2025. Counsel further submits that the name of the petitioner has figured only due to the reason that he is friend of son-in-law of the informant, save and except nothing has come against him.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that it is the categorical allegation in the FIR that petitioner alongwith his friend went to Chandan Dam and thereafter, dead body of the daughter of the informant was recovered.
6. It is a case of strong suspicion and therefore, this Court is not inclined to enlarge the petitioner on bail in connection with Bandhua Kurawa P.S. Case No. 111 of 2024 pending in the court of learned Chief Judicial Magistrate, Banka. Hence, the prayer for bail of the petitioner is hereby rejected.
