2. This criminal appeal has been filed against the order dated 25.03.2023 passed by learned Exclusive Special Judge SC/ST, Gaya in connection with Civil Lines P.S. Case No. 553 of 2021, registered under Sections 302, 120(b)/34 of the Indian Penal Code and Section 3 (ii) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and Section 27 of the Arms Act, whereby the prayer for anticipatory bail of appellant has been rejected.
3. As per prosecution case, all the F.I.R. named accused persons caused death of the brother of the informant.

4. It is submitted appellant is not named in the F.I.R. Name of the appellant transpired during course of investigation on confessional statement of co-accused Baun Yadav @ Pramod Yadav and except confessional statement there is no other material to show the complicity of the appellant in the present case.
5. However, learned Spl. Public Prosecutor appearing for the State vehemently opposes the prayer for bail application and submits that this appellant and other named accused persons caused death of the brother of the informant and appellant has got seven criminal antecedents.
6. Considering the gravity of accusation and criminal antecedents, I do not find any ground to interfere with the order of the learned court below and as such, the appeal, which has been filed for grant of anticipatory bail, is hereby rejected. (Prabhat Kumar Singh, J) Navya/- U T
