====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 304B, 201 and 120B of the Indian Penal Code.

Allegation is that death for non-fulfillment of dowry demand was caused to the wife of the petitioner, by the petitioner and other in-laws.

Submission is that admittedly death took place after seven years of her marriage and there is no eyewitness of the occurrence of murder. Some other co-accused were allowed anticipatory bail in this matter vide order dated 10.04.2012 passed in Cr. Misc. No. 6053 of 2012 (Annexure-3 series). Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No.39185 of 2019(5) dt.26-09-2019 2/2 bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Baruraj Police Station Case No. 73 of 2011, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
