JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to prosecution case itself, the marriage of deceased had taken place with the petitioner in the year 1998 and after marriage she gave birth to a child but subsequently, she was derailed mentally and thereafter petitioner solemnized his second marriage with another woman. The post mortem report of the deceased reveals that cause of death of the deceased was mal nutrition and infection on the scalp.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.36627 of 2015 (2) dt.31-08-2015 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Simri P.S. Case No. 211 of 2014.
