2. The petitioner has preferred this application for grant of regular bail in connection with Jamalpur Rail P.S. Case No. 71 of 2024 registered for the offences punishable under Section 303(2) of the BNS.

3. As per the prosecution story, the informant has alleged that on 24.07.2024 at around 7:30 PM, he went to Jamalpur Railway Station to see off his relatives and parked his motorcycle near the portico. However, when he returned, he found that his motorcycle was missing.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. The petitioner is not named in the F.I.R., which was lodged against unknown persons. However, during the

Patna High Court CR. MISC. No.34701 of 2025(4) dt.01-09-2025 2/2 course of investigation, the petitioner's name surfaced in this case. It is further submitted that, based on CCTV footage, the name of one Anand Kumar emerged, who allegedly confessed before the police that he had committed theft of several motorcycles and, after doing so, handed over them to the petitioner in exchange for money. It is also submitted that charge has been framed against the petitioner and he is in languishing in custody since 21.10.2024.

5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

6. Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate Kiul in connection with Jamalpur Rail P.S. Case No. 71 of 2024 subject to the condition that one of the bailor shall be his family member.
