For the Petitioner : Mr. S.B.K. Mangalam, Advocate For the Respondents : Mr. Amit Shrivastava, Advocate Mr. Ritesh Kumar, Advocate =================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 23-08-2016 Heard parties.

It appears that the election petition concerned was filed on 22.06.2016 itself. On 29.06.2016, notices were issued and the matter was directed to be posted on 22.08.2016 itself but without waiting further, this writ application has been filed by the petitioner for a direction of early disposal of the election petition as if Subordinate Judge is not serious about the nature of litigation in an election petition. After the perusal of order sheet, this Court is not at all satisfied with the plea that the court concerned is not serious.

Patna High Court CWJC No.13777 of 2016 dt.23-08-2016 However, at the time of hearing, upon the request of the learned counsel for the petitioner, indulgence is granted to strike off that part from the relief and other portions of the writ petition in which allegation has been made against the court concerned of not being serious about the nature of litigation, in course of the day. Since the election petition is required to be disposed of expeditiously, this writ application is being disposed of with expectation that the Sub-Judge-1, Saharsa would take steps for expeditious disposal of Election Petition No. 13 of 2016.
