Perused the order dated 18.06.2016 passed by the A.D.J.-II, Civil Court, Samastipur in Probate Case No. 02 of 1995, whereby the court below rejected the application filed by the petitioner praying for issuance of notice to the other opposite party in probate case and also for framing proper issue. 3.

It may be mentioned here that this petitioner is opposite party in the probate case and, therefore, it is not expected from opposite party that he will control the proceeding in the court. Accordingly, the court below has passed the reasoned order, therefore, I find no reason to interfere with impugned order in exercise of supervisory jurisdiction. Thus, this civil miscellaneous application is dismissed.
